Terms of Service

1. Agreement

These Terms are an agreement between you and Chesterfield Flow ("we," "our," or "us") for the use of chesterfieldflow.com and its data, dashboards, and alerts (the "Service"). By using the Service or starting a subscription, you agree to these Terms and to our Privacy Policy. You must be at least 18 years old. If you do not agree, do not use the Service.

2. Not Investment Advice

Chesterfield Flow is not a registered investment adviser, broker-dealer, or financial planner. Everything on the Service, including options-flow data, gamma exposure levels, alerts, and commentary, is general information for educational purposes. It is not a recommendation to buy, sell, or hold any security, option, or future, and it does not consider your personal financial situation.

Trading options and futures involves substantial risk of loss and is not suitable for everyone. You can lose more than you invest. Past results, including any examples shown on the Service, do not predict future results. You alone are responsible for your trading decisions. Consider speaking with a licensed financial professional before you trade.

3. Market Data

Market data comes from third-party sources and may be delayed, incomplete, or inaccurate. The Service may be unavailable at times, including during market hours. We do not guarantee the accuracy, timeliness, or availability of any data, and you should not rely on the Service as your only source of information.

4. Accounts and Login

You sign in with a one-time link sent to your email address. Keep your email account secure; anyone who can read it can sign in as you. A subscription is for one person. Do not share your account, login links, or session with anyone else. We may suspend accounts that we reasonably believe are shared.

5. Subscriptions, Free Trial, and Automatic Renewal

• Plans. Monthly: $249 per month. Annual: $2,490 per year. Prices are in U.S. dollars plus any applicable tax. The price shown at checkout applies.
• Free trial. New subscribers get a 5-day free trial. A payment card is required to start it. Unless you cancel before the trial ends, your subscription starts automatically and your card is charged the plan price when the trial ends.
• Automatic renewal. Your subscription renews automatically every month or every year, at the then-current price, and your card is charged at each renewal until you cancel. We will tell you about a price change before it applies to you.
• How to cancel. Cancel at any time online through "Manage billing" after you sign in, or by emailing support@chesterfieldflow.com. Cancellation stops future charges. You keep access until the end of the period you already paid for.
• Refunds. The free trial is your chance to evaluate the Service. Payments are non-refundable, including partial months or years, except where the law requires a refund.
• Failed payments. If a payment fails, we may suspend access until it succeeds.

6. Acceptable Use

You may use the Service for your own personal trading research. You may not:

• Copy, republish, redistribute, resell, or sublicense data or content from the Service.
• Scrape the Service or extract data with bots, scripts, or other automated means.
• Get around login, access limits, or security, or reverse engineer the Service.
• Use the Service for anything unlawful, including market manipulation.

Some data is licensed from exchanges and data vendors, and their terms may limit how it can be used. We may change or restrict access to data when a provider requires it.

7. Intellectual Property

The Service and its software, design, and content belong to Chesterfield Flow and its licensors and are protected by copyright, trademark, and other laws. These Terms do not give you any ownership rights.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent the law allows.

9. Limitation of Liability

To the fullest extent the law allows, Chesterfield Flow is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading losses, lost profits, or lost data, arising from your use of or inability to use the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Indemnification

You agree to defend and indemnify Chesterfield Flow against claims, losses, and costs that arise from your breach of these Terms or your misuse of the Service.

11. Termination

You may cancel at any time as described in Section 5. We may suspend or end your access if you breach these Terms, including by sharing your account or redistributing data. If we end your access without cause, we will refund the unused part of any prepaid period.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Santa Clara County, California, and you and we consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms. When we do, we update the date at the top. If a change is material, we email active subscribers before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
